Asbestos Case Management

For many years, the firm has served as national counsel to a major manufacturer involved in thousands of asbestos disease cases throughout the United States. This is based upon the firm’s decades of experience with asbestos litigation and asbestos case management, notably for Johns Manville Corporation.

Managing a multi-thousand case docket requires both the substantive knowledge of the litigation and the management skills and experience to direct the litigation nationwide. It is a bit like being the general manager and coach of a football team. As national counsel, one selects the local counsel to work in the various states, one becomes familiar with the strengths and weaknesses of factual and legal issues in given jurisdictions, and one develops the overall litigation strategy, evaluates the cases, negotiates settlements, directs discovery issues and directs the activities of local counsel. In short, when it comes to local counsel, national counsel calls the plays. All of this requires a high degree of risk-benefit analysis and being a good steward of the client’s resources, reputation and best interest.

Asbestos case management on a national basis is a skill that can be learned only with years of experience, and there are but a handful of firms in the United States well-equipped to handle this task. Fortunately, Markusson Green & Jarvis is one of those firms and is well-regarded nationally for its asbestos case management skills.
